Comi Chat Terms of Use

1. ACCEPTANCE OF AGREEMENT

These Terms of Use (the “Agreement”) constitute a legal agreement that governs the relationship with users and others who interact with Comi Chat application and our subsidiaries and affiliates (“Comi,” “we,” or “us”) in connection with the use of our websites (the “Sites”) and our Service.

Comi Chat provides various services, products, and features—including websites, mobile apps, social media integrations, and downloadable content—collectively referred to as the “Service.” Comi Chat may add, modify, or discontinue any part of the Service at any time. These changes will be subject to this Agreement, and Comi Chat will not be liable for any modifications or interruptions in service.

Some parts of the Service may have Additional Terms, which will be provided when you sign up or use those features. These terms also form part of this Agreement.

Anyone who uses the Service is considered a “user.” If you create an account, you become a “Member.”

2. USE OF SERVICE

You agree to use the Service in compliance with this Agreement and all applicable laws.

2.1 Profile: You may create only one valid profile. Be aware that information you make public can be seen by anyone.

2.2 Safety: The Service involves sharing personal information. Comi Chat does not guarantee that contact with other users is safe. Internet technology makes it possible for others to find and use your personal information with minimal data. If you feel harassed or that your information is being misused, contact local law enforcement first, then report to us so we can take action.

You assume all risks related to using the Service, including online or offline interactions such as dating. Always be cautious when meeting strangers. Comi Chat does not perform criminal background checks on all members, does not guarantee member behavior or compatibility, and does not assist with travel documentation. Comi Chat may perform screenings at its discretion using public records. Note that not all profiles are real users—some may be test accounts for service monitoring.

2.3 Profile Security: You are responsible for keeping your username and password confidential, and for all activities under your account. Notify Comi Chat immediately of any unauthorized use. Comi Chat is not liable for losses resulting from stolen or misused credentials.

2.4 Personal Use: The Service is for personal use only. You may not authorize others to use it on your behalf, transfer your rights, or use your profile for others.

2.5 No Commercial Use: Do not advertise, solicit, or spam through the Service. Do not contact users for commercial purposes without their explicit consent. You may not transfer your access rights unless permitted by this Agreement.

2.6 User Conduct: Comi Chat is not responsible for user behavior. Use the Service at your own risk. You agree not to:

- Use the Service unlawfully or harm others

- Harass, threaten, stalk, or engage in predatory behavior

- Disrupt the Service or interfere with other users

- Impersonate others or misrepresent yourself

- Defraud or deceive users

- Share others’ personal information without permission

- Solicit personal information for unlawful purposes

- Gamble or conduct illegal activities

- Use automated tools to scrape or access the Service

- Phish, troll, or redirect users to other sites

- Send spam or unsolicited messages

- Promote prostitution or sex trafficking

- Access unauthorized parts of the Service

2.7 Reporting Violations: To report violations, use the report function on the Service. If Comi Chat determines you have violated this Agreement, misused the Service, or acted inappropriately or illegally, it may investigate, take legal action, terminate your account, and/or report you to authorities. Comi Chat will cooperate with lawful enforcement requests.

2.8 Repeat Offender Policy: Users who repeatedly violate rules may be permanently suspended or blocked from the Service.

3. PAID SERVICE

3.1 General

If you purchase any paid features offered by Comi Chat (“Paid Service”), you authorize Comi Chat and its payment processors to store your payment details. You agree to pay all applicable fees, taxes, and any overdue collection costs.

Fees are generally non-refundable, and no refunds or credits are provided for partially used services—except where stated in this Agreement, required by law, or at Comi Chat’s discretion. Additional refund details may be found in relevant sections of this Agreement.

Payment may be required in advance, in arrears, or per use, as specified at the time of purchase. Comi Chat may change prices at any time without prior notice, unless otherwise stated in this section.

3.2 Payment Method

You may pay using various methods, such as credit/debit card or mobile payment. You authorize Comi Chat to charge your selected payment method(s) and agree that Comi Chat may receive updated payment details from you or your payment provider.

If your payment method fails, you agree to pay all due amounts upon request. Continued use of Paid Services confirms your authorization for Comi Chat to charge your chosen payment method.

Paid Services may also be purchased through third-party accounts (e.g., Google Play). In such cases, billing will be handled by the third party, and you are subject to their terms and conditions.

4. USER CONTENT

You are solely responsible for all content you post or share through the Service ("User Content"). Comi Chat does not control or assume liability for any User Content, including losses or damages resulting from it. We are not responsible for offensive, inaccurate, or inappropriate content you may encounter.

4.1 Accuracy of Information

Do not post inaccurate, misleading, or false information. You may be required to provide certain details and a personal photo to use the Service.

4.2 Content Moderation

While Comi Chat has no obligation to monitor User Content, we reserve the right to review, edit, or remove it at any time to ensure safety and platform integrity. You are responsible for backing up your content at your own cost. Comi Chat may also modify or edit your photos to comply with our policies.

4.3 License to Comi Chat

You retain ownership of your User Content. However, by posting it, you grant Comi Chat a permanent, worldwide license to use, modify, and distribute your content—including for commercial purposes. You confirm that your content does not violate third-party rights and release Comi Chat from related claims. No additional compensation will be provided for the use of your content.

4.4 Respect Others' Rights

Do not post, copy, or distribute copyrighted or proprietary material without permission. Assume all content may be protected unless stated otherwise.

4.5 Prohibited Content

You may not post content that:

- Is obscene, abusive, harassing, defamatory, fraudulent, or illegal

- Promotes racism, hatred, or physical harm

- Infringes intellectual property or privacy rights

- Enables illegal activities (e.g., drugs, weapons)

- Contains viruses or harmful code

- Includes unauthorized advertising

- Is deemed objectionable by Comi Chat

We have a zero-tolerance policy toward child exploitation and will report such content to authorities.

4.6 Enforcement

Comi Chat may monitor usage but has no obligation to do so. You can report prohibited content confidentially through the in-app system.

Comi Chat reserves the right to suspend or ban any user, without notice or liability, for any reason. Refunds will only be given as expressly stated in this Agreement.

4.7 Submissions

Any feedback, ideas, or materials you voluntarily submit to Comi Chat become our sole property. We may use them for any purpose without compensation or acknowledgment.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Ownership of Materials

All content and materials provided through the Service—including software, interfaces, images, text, logos, trademarks, and other users' content—are the intellectual property of Comi Chat and its licensors. This Agreement does not grant you any rights to these proprietary materials unless explicitly stated.

5.2 Permitted Use and Restrictions

You are granted a limited, revocable license to access and use the Service in accordance with this Agreement. You agree not to:

- Copy, modify, decompile, or reverse engineer any part of the Service

- Frame or mirror any portion of the Service without authorization

- Use meta tags or other methods to redirect users to other websites

- Resell or make commercial use of the Service

- Employ data mining, bots, or automated content extraction

- Forge headers or disguise the origin of information transmitted

- Use automated methods to create accounts or access the Service

- Use the Service or materials for any purpose other than intended

Any unauthorized use may result in termination of your license and violate applicable laws. Comi Chat reserves all rights not expressly granted herein.

5.3 License Termination

Comi Chat may revoke your access and usage rights to the Service at any time, at its sole discretion.

6. LIMITATION OF LIABILITY

You acknowledge and agree that Comi Chat cannot control user conduct and therefore assumes no liability for harm caused by other users or third parties. We are not responsible for any actions, content, or data provided by others, and you release Comi Chat, its affiliates, directors, officers, employees, and agents from all claims related to your interactions with users or third parties.

To the fullest extent permitted by law, Comi Chat shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangibles, even if advised of such possibilities. This includes damages resulting from:

- Inability to use the service

- Costs of substitute goods or services

- Unauthorized access to or loss of your content or data

- Conduct of any user or third party

- Any other matters relating to Comi Chat

You may encounter offensive, inappropriate, or objectionable content or behavior from other users, but you agree not to hold Comi Chat responsible for such experiences.

Comi Chat is not liable for any lost, deleted, or damaged content, nor for failures in storing or delivering communications or personalization settings.

7. TERMINATION AND REMEDIES

If Comi Chat determines that you have violated these Terms, misused the app, or engaged in inappropriate or unlawful conduct, it may take one or more of the following actions without liability:

- Issue a warning via email

- Remove your User Content

- Terminate your account and paid service without refund

- Refer matters to law enforcement and cooperate fully in investigations

- Take any other action deemed appropriate

All termination decisions are at Comi Chat's sole discretion. Termination results in the removal of your access to the account and all associated content. Certain terms will remain in effect after termination, including arbitration agreements, ownership clauses, warranty disclaimers, and liability limitations. Your data will be handled according to our Privacy Policy.

8. CHANGES TO THIS AGREEMENT

We may update this Agreement periodically. The "Effective date" at the top will reflect any changes. We will notify you of significant updates through the Service.
